These Terms and conditions shall by governed by and construed in accordance with the laws of New South Wales.
We will only accept orders on this web site by persons over the age of eighteen (18). By placing an order on this web site, you acknowledge that you are at least 18 years old.
We sell and ship products within Australia only.
By placing an order on this website, you make an offer to us to purchase the goods you have selected based on these Terms and Conditions. Information contained on this web site constitutes an invitation to treat and does not constitute an offer by us to sell any goods. Buy Smarte reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion. We confirm acceptance of your order when you receive a “Complete” status on your order confirming your order has been dispatched with any relevant tracking details.
All orders placed on this site are in Australian Dollars (AUD).
All prices quoted on this site are inclusive of GST.
All items advertised on this web site are subject to availability. Any items which are represented as “In Stock” on our website may not be available from time to time due it being sold either in-store, eBay or any other selling platform Buy Smarte may engage. However we will notify you as soon as possible if the item you ordered is not available by email or telephone, and provide you with the option of a similar product, have it back ordered, provide a store credit or a full refund. In any such event we apologise for the inconvenience this may cause and we will work together with you to ensure any issues are rectified at the first available opportunity.
Products that are marked as "Avaiilable to Order" generally means that the product is currently not in our warehouse and needs to be ordered from our supplier for delivery to us and then to you, or direct to you from our Supplier. We advertise these items as 4-7 business days in dispatch however most items will dispatch much faster but in some cases much slower than 7 business days so this is to be used as a guidline only. If you are under time pressure, it is best to contact us for an exact ETA before placing your order.
Pickup From Our Warehouse: We utilize several warehouses and therefore stock may need to be transferred to our pickup warehouse and therefore we will advise you when stock is ready for collection.
Delivery of your goods
Pickup is not available on orders paid with Paypal.
Orders are shipped within 1-7 days from our warehouse. Stock availability is subject to your location. Please allow up to 10 days for your order to arrive via courier event though this will be generally sooner.
All confirmed orders are sent using a tracking number from the various carriers we rely on to dispatch your goods. Our Standard shipping using courier companies is to your Building's door service, contact us if this is not suitable for you to discuss options and additional costs. Please visit the relevant carrier’s site to track and trace your order using the tracking number provided to you via email.
Goods are delivered by Australia Post and various carriers depending on the size of the item and also your location. We also deliver in our own trucks for all bulky goods within the Sydney metropolitan area.
If you need to change any delivery details, please advise us by phone or email at least 1 day in advance.
We reserve the right to charge for the cost of redelivery if you are not home on the designated day of delivery.
Our couriers deliver Monday to Friday 9am to 5pm. Weekend delivery and after hours delivery is currently not available.
You may leave a written 'Authority To Leave' (ATL) for the driver, granting permission for the goods to be left without a signature if no one is home to receive the delivery. Please bear in mind however, that providing an Authority To Leave will waive any delivery protection and you would need to follow up directly with the courier for assistance if anything were to happen to the unattended package. We strongly discourage you from giving authority to leave unless you are comfortable to repurchase the item if you do not receive it and agree that you may not contact us for a resolution to lost items/undelivered with security camera footage proof or otherwise. PLEASE DO NOT GIVE ATL.
Please also note that failure to collect your package from the courier may result in the item being returned to us, incurring re-delivery or re-stocking charges.

Returns & Exchanges Policy
If you change your mind about a purchase, we will gladly accept return of your goods for either a store credit or a cash refund minus a 15% restocking fee and the original delivery fee subject to the item(s) are boxed and unopened and you pay the associated shipping costs in relation to returning the item to us within 14 days from receiving them. For orders which have not yet been delivered, an administrative charge of $33 (including GST) will be charged if you wish to cancel your order for a refund so please choose carefully.

All Brand New products at Buy Smarte come with a minimum 12 Months Manufacturer’s Warranty. You may contact the manufacturer directly in relation to any warranty claims and the relevant contact details can be found here.We can assist you if required.
All Factory Seconds products at Buy Smarte come with a 12 Months Back to Base Warranty unless otherwise specified.
- All Factory Second Products from Samsung, LG, Breville, Medion, Delonghi & Panasonic come with a back to base warranty therefore you must retain the original packaging in the unlikely event the item must be returned to us under warranty. We will not accept responsibility for any loss or damage suffered if you do not comply with the Returns & Exchanges Policy as well as the Terms and Conditions set out on this page.
Customers are encouraged to refer to the product user manual first to help troubleshoot any issues which may occur. We can also be contacted to help troubleshoot any issues. In the unlikely event that there is no-fault found or if the fault is due to user-error, then a No-Fault Call Out Fee of $150 including GST will be charged.
It is the customer’s responsibility to understand the terms and conditions of warranty prior to purchasing any products.
You will need to provide proof of identity at the time of accepting delivery of your goods. We reserve the right to refuse delivery if suitable identification cannot be provided and a redelivery fee will be charged if the item needs to be redelivered.
We reserve the right to undertake fraud check on credit card payments and release the goods when satisfied that the transaction is legitimate.
Limitation of Liabilities
Buy Smarte shall not be liable in contract or in tort for any loss or damage suffered and consumer rights are limited to those set out under these Terms and Conditions and under statute. To the extent permitted by applicable laws, Buy Smarte does not accept any liability for:
- any damage or injury of any kind caused by the use or misuse of products purchased from us
- errors, mistakes or inaccuracies on the website
- failing to act on any information contained on or referred to on this web site or any linked website
- unauthorised access to or use of our secure servers, personal information and financial information stored on these servers
- any interruption or cessation of transmission to or from our web site
- any bugs, viruses, Trojans or other harmful code or communications which may be transmitted to or through this web site or by any third party.

Delivery & Installation Limited liability
-We cannot deliver to a post office box (PO Box), parcel locker, Locked Bag address or similar service;
-Our delivery vehicle must be able to park safely within 20 metres of the access point of the delivery location and the delivery address must at all times be safe, clean and free of risk (eg hazards and pets securely restrained).
-We reserve the right to refuse to deliver if this condition is not met;
-Delivery times and dates are estimates only and are subject to weather, traffic, postal contingencies, the actions of our agents and other factors, therefore
-we cannot guarantee delivery on the date we arrange with you;
-We will take reasonable care during delivery, however delivery of appliances inherently carries with it a risk of damage (eg wet or scratched floors, scuffed walls). To the extent permitted by law, we are not liable for any damage caused to property during delivery, including as a result of our or our driver's negligence;
-All deliveries must be accepted at the delivery address by you or your nominee as advised in advance. You or your nominee must be a person at least 18 years of age, have photographic and/or credit card identification as authorised prior to delivery and be able to sign for receipt of your goods. Buy Smarte reserves the right to request the credit card holder to be present at delivery from time to time;
-The Customer must notify us within 24 hours of delivery of any damage to Goods or if the Goods are inconsistent with the Customer's order. Failing such notice, and to the extent permitted by law, the Customer will otherwise be deemed to have accepted the Goods.
-Nothing in this document will exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy mandated or otherwise implied by law, including under the Australian Consumer Law, which cannot by law be excluded, restricted or modified. To the extent there is such a term, it is severed but only to the extent necessary to conform with the applicable law.
To the extent permitted by law, Buy Smarte is not liable for any delays in performing any of its obligations under these Terms and Conditions if such a delay is caused by factors beyond our reasonable control and we shall be entitled to a reasonable extension of time to perform or fulfil such obligations.
